Abstract

The present article, entitled "Sovereignty and the Democratic Rule of Law," aims to explore the relationship between sovereignty and democratic principles. It follows, in stages, doctrinal interpretations developed through a multidisciplinary lens, drawing from Philosophy and Political Science, and grounded in the principles of Constitutional Law. Based on a theoretical-legal perspective, the study adopts a qualitative approach focused on understanding the challenges faced by the Modern and Contemporary State. The findings reveal that Brazil, immersed in a context of declining national sovereignty and democratic setbacks, faces persistent obstacles to the realization of fundamental rights, which have often been neglected or only partially fulfilled throughout its history. Ultimately, the study concludes that this situation exposes structural weaknesses within the State, significantly undermining Brazil’s constitutional order, stability, and integrity.
