PROBLEMAS EMERGENTES NAS REGULAMENTAÇÕES QUE REGEM ATIVIDADES AO PÚBLICO ADOLESCENTE

Abstract

This article aims to examine the legal framework established to protect minors in electronic sports competitions, investigating emerging challenges and regulatory gaps in this constantly evolving field. Grounded in key relevant legislations such as the Child and Adolescent Statute (Law No. 8,069/1990) and the Pelé Law (Law No. 9,615/1998), the study adopts a qualitative methodological approach, grounded in theoretical and argumentative analyses. It explores the origins of E-Sports in relation to traditional sports and investigates Brazilian legislation related to E-Sports, with a special focus on the protection of minors. The increasing importance of E-Sports as a popular form of entertainment and competition is highlighted. The study underscores the need for more comprehensive and effective policies and regulations, addressing issues such as data protection, minors' participation in electronic gaming competitions, and promoting greater awareness of child and adolescent protection in digital environments. By understanding the legal and regulatory landscape of E-Sports in Brazil, this research aims to contribute to the development of safer, fairer, and more inclusive environments for E-Sports practitioners and enthusiasts, highlighting the need for effective legislation capable of serving the community, without placing all responsibility on self-regulation and infra-legal norms.
