Abstract

The violence against woman is one of the most serious forms of violation of human rights, since the treatment reserved for the female gender was based on subservience and submission to the male in all spheres of society. This reality contributed striking shape to the naturalization of a male chauvinist culture that was consolidated through psychological, economic and sexual power in the relationship between the sexes. So, we propose to do a search a historical-social  on the causes of violence against woman, from the point of view of the norm and measures of combat and prevention in the Brazilian context. With the objective to analyze why the Maria da Penha and Feminicide Laws are ineffective in the current Brazilian social conjuncture, and how this type of violence impacts women's quality of life.  We adopted a methodology of a bibliographic, jurisprudential and legislative nature, using the historical, conceptual and statistical research method that served as the basis for the theoretical and argumentative foundation of the research. It is known that the alarming data on violence against woman show how much we need effective public policies that actually impact the re-education and re-socialization of the aggressor, as proposed by the Maria da Penha Law. Therefore, it is necessary to understand that only through this change, we will be able to deconstruct the domination of men over women. It is evident that only by using repressive measures we will not be able to reverse this lamentable abusive situation, as these measures have only been a palliative and have not shown any satisfactory result.
