Abstract

ABSTRACT: The work focuses on analyzing the problem about resocialization, permeated by theory and practice. Seeking to systematically study the gaps between law and reality, looking at the true role of punishment in society, taking into account the Democratic State of Law. Therefore, the research was methodologically carried out in a bibliographic way, the main object of study being Law 7,210 of July 1984 in its articles 3 and 41, the theory of positive special prevention and the most diverse doctrinal opinions on the subject. It is also listed viable possibilities in the insertion of really active projects in prisons. The bibliographic methodology is chosen, since our focus revolves around the law and doctrine. Concluding that the importance of theory is fundamental for the construction of a real model, which, however, needs to get off the ground and cover most of this precarious population, since benefiting only a minority does not reach the collective objective of the penalty, which is the reintegration of individuals into society in a dignified and safe way, for the whole.
