A POSSIBILIDADE DA UTILIZAÇÃO DE CRIPTOATIVOS NO COMETIMENTO DE CRIMES ECONÔMICOS.
Abstract
The present research aims to present the legal difficulties to combat economic crimes that use cryptoassets as a tool. Through the explanation of the functioning of the blockchain and its derivatives, presenting the capacity of this new technology, in comparison with the current way of acting of the regulators. For that, the type of legal-dogmatic reasoning is used, in particular. In this sense, the wide possibilities of applicability that it can offer are presented, which allows the transfer of any value, to any place, with a possible anonymity. Subsequently, the existing regulations and the projects are compared, showing the still undefined confrontation of competences. The research is justified due to the absence of efficient measures that seek to reduce the impact on the State worldwide and in Brazil, through the commission of illicit practiced, mainly, by criminal organizations that protect themselves with the use of encryption technology.
